Joseph John Bergeron appeals his conviction for murder in the first degree in violation of Minnesota Statutes ? 609.185(3) (1988), intentional murder while committing or attempting to commit a burglary. The conviction arose from the stabbing death of Thomas Berger. After a jury trial, defendant was sentenced to life imprisonment. Before this court he argues that the trial court erred in admitting a so-called dying declaration, that there was insufficient evidence to show that he committed a burglary or that he acted with intent to kill, and that the trial court erred in excluding testimony from defendant concerning his intent when he entered Bergers home. We affirm the conviction.
